These Terms of Use (“Terms”) govern your use of the SkyWave mobile application (the “App”) and the skywaveradio.app website (the “Site”), together the “Service,” operated by SkyWave (“we,” “us,” “our”). By installing or using the Service you agree to these Terms. If you don’t agree, don’t install or use the Service.
1. Who can use the Service
The Service is intended for use by amateur radio operators and people interested in HF (high frequency) propagation. You are responsible for understanding and complying with the regulations that apply to your station and license class in your jurisdiction. The Service is not directed at children under 13.
2. License to use the App
We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, for personal, non-commercial use, subject to these Terms and to the terms of the app store from which you obtained the App.
3. Acceptable use
You agree not to:
- Reverse engineer, decompile, or attempt to extract the source code of the App except as expressly permitted by law.
- Use the Service to violate any law or any third party’s rights.
- Interfere with the Service’s operation, including by attempting to bypass rate limits or by sending traffic intended to degrade availability.
- Resell, sublicense, or redistribute the App or its content.
- Use the Service in safety-critical contexts where its failure could cause injury, property damage, or loss.
4. Information and recommendations
The Service surfaces public space-weather data (NOAA Space Weather Prediction Center and the KC2G MUF map) and presents band recommendations derived from it. Recommendations are estimates, not guarantees. Actual propagation depends on equipment, antennas, terrain, noise, and conditions that change minute to minute. The Service is not a substitute for regulation, good engineering practice, or on-air judgment, and we do not warrant that any recommendation will result in a successful contact, contest result, or activation.
5. Third-party data and links
The Service depends on third-party data sources and platforms (NOAA, KC2G, Google Firebase, Cloudflare, the App Store, and Google Play). We do not control those services and are not responsible for their availability, accuracy, or terms. Links from the Site to third-party resources are provided for convenience; following them is your decision.
6. Privacy
Your use of the Service is also governed by the Privacy Policy, which describes what data the Service collects and how we use it. By using the Service you agree to the data practices described there.
7. Intellectual property
The Service, including its software, design, copy, and branding, is owned by us and protected by copyright and other laws. These Terms do not transfer any of those rights to you. The names “SkyWave” and “SkyWave Radio” and the SkyWave wordmark and icon are our trademarks.
8. Changes to the Service
We may add, change, or remove features at any time, and we may stop offering the Service in whole or in part. We will try to give reasonable notice of material changes through the Site or through the App, but we are not obligated to.
9. Disclaimer of warranties
The Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or accurate. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.
10. Limitation of liability
To the maximum extent permitted by law, in no event will we be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of the Service. Our total liability for any claim arising out of or relating to these Terms or the Service is limited to fifty U.S. dollars (US$50).
11. Indemnity
You agree to defend, indemnify, and hold us harmless from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any law or third-party right.
12. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including a violation of these Terms. You may stop using the Service at any time by uninstalling the App.
13. Governing law and disputes
These Terms are governed by the laws of the State of Oregon, United States, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Oregon, and you consent to the personal jurisdiction of those courts. If you live in a jurisdiction whose consumer-protection laws give you mandatory rights that override these terms, those mandatory rights still apply.
14. Apple-specific terms (iOS only)
If you obtained the App from the Apple App Store, you acknowledge:
- These Terms are between you and us, not between you and Apple. Apple is not responsible for the App or its content.
- Apple has no obligation to provide maintenance or support for the App.
- In the event of a failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). Apple has no other warranty obligation with respect to the App.
- We, not Apple, are responsible for addressing any claim relating to the App, including product-liability and consumer-protection claims.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
15. Changes to these Terms
We may update these Terms from time to time. The Effective date at the top of this page will change when we do. Your continued use of the Service after a change means you accept the updated Terms.
